    • возврата компенсированного НДС – предоставляется налогоплательщикам в отношении налоговых структур, с целью обеспечения возврата налогов.
    • использования марок – выдаются в рамках регулирования рынка алкогольных товаров, обеспечивая выполнения всех договоренностей его участниками.

    Специальные гарантии

    Это гарантии, предназначенные для поддержки повседневного ведения бизнеса. Основные виды специальных гарантий:

    • судебные – выдаются в рамках ст. 94, ч. 6 АПК РФ, по просьбе истца в отношении ответчика, при встречном обеспечении по судебному иску;
    • обеспечения экспорта подакцизной продукции – предоставляются в отношении налоговых структур по просьбе налогоплательщика, в плане продажи подакцизной продукции;
    • контргарантии – предоставляются в пользу стороннего банка, выступающего эмитентом гарантий;
    • покупки акций открытого АО – выдаются по поручению лица, который собирается приобрести более 30% акций;
    • обеспечения выполнения договоренностей по переводу выручки за реализованные билеты – предоставляются субъектам, которые занимаются продажей авиа- и ж/д билетов в пользу организаций, являющихся непосредственными перевозчиками.

    • Организационно-правовую форму.

    Требования к клиентам

    Получить гарантию могут ИП, а также юр. лица с организационно-правовой формой ООО, ОАО, ЗАО.

    • Наличие хотя бы 1 стандартной налоговой отчетности, предоставленной в ФНС.
    • Отсутствие расчетных документов, невыплаченных в срок.
    • Отсутствие фактов привлечения к уголовной ответственности учредителей организации.
    • Заказчик не является участником судебных разбирательств, и у него отсутствуют неисполненные судебные иски.

    Необходимые документы

    Для получения гарантии нужно предоставить:

    • Копии паспортов учредителей и руководителя.
    • Свидетельство о госрегистрации.
    • Свидетельство о постановке на налоговый учет.
    • Лицензии, если деятельность подпадает под лицензирование.
    • Учредительные документы.
    • Бухгалтерскую и налоговую документацию за последний отчетный период.
    • Бумаги, подтверждающие полномочия представителя юр. лица на заключение соглашения.
